Terms of Sale and Use

These terms cover your use of this website and every order you place on it. Please read them before you buy, because placing an order means you accept them.

Cambay is one of three brand sites run by AuraByt Inc., and the brand you are shopping is decided by the website address you are on. Whichever of our sites you use, your contract is with AuraByt Inc. and these terms apply.

Who you are contracting with

When you buy from Cambay, you are buying from AuraByt Inc., a company based in Brampton, Ontario. We sell fashion online, direct to you, and we are the only seller on this site. No marketplace seller, reseller or other merchant is involved in your order.

In these terms, "we", "us" and "our" mean AuraByt Inc., and "you" means the person placing the order.

Eligibility and your account

You must be at least 18 years old to order from us, and you must be authorized to use the payment method you pay with.

You can check out as a guest or create an account. If you create an account:

  • Keep your password to yourself, and email us at support@tanahq.com if you think someone else has it.
  • You are responsible for orders placed and changes made under your account.
  • Keep your email address and shipping details accurate, because that is where your order and its updates go.

Some things need an account. Starting a return yourself in the account area is one of them, because we have to know the order is yours. If you checked out as a guest, email us at support@tanahq.com and we will start the return for you.

We can suspend or close an account that is being used to break these terms.

Products, photography and colour

We photograph and describe every item as accurately as we can. Even so, colour, texture, drape and scale can look different on your screen than in person, and no two screens show a colour the same way. Fabric, trim and small construction details can also vary a little between production runs of the same design. A small variation of that kind is not a fault.

Measurements and size guidance are a guide to fit, not a promise of it. If an item is genuinely not what the page described, that is a fault and the return is on us. See shipping and returns.

Prices and currency

You are charged in the currency of the country you are shipping to. Orders shipped to Canada are priced and charged in Canadian dollars. Orders shipped to the United States are priced and charged in US dollars. We ship to Canada and the United States only.

Prices on US orders already include our estimate of the import duty on bringing the item into the United States. We do not calculate or collect a separate duty or customs charge at checkout, there is no brokerage fee to pay us, and nothing further is collected from you on delivery.

If a carrier ever asks you to pay duty, a customs charge or a brokerage or handling fee on an order from us, email support@tanahq.com before you pay it. If you have already paid one, send us proof of what the carrier charged you and we will refund it.

Prices, promotions and availability can change at any time, and an item can sell out while it is sitting in your cart. The price that applies to your order is the one shown at the moment you place it.

Now and then a price or description is plainly wrong: a decimal point in the wrong place, a currency mixed up, a garment listed for a fraction of what it costs. Where the error is obvious, we are not required to sell at that price. We will cancel the affected order or item, tell you why, and refund you in full. You are never charged extra without being asked first.

Taxes

On Canadian orders, GST and HST are charged according to our tax registration, and provincial sales tax is added only in the provinces where we are registered to collect it. Tax is shown as its own line in your cart before you pay, and again on your order confirmation.

We do not collect US sales tax. Nothing is added for sales tax on an order shipped to the United States.

How an order becomes a contract

Placing an order is an offer to buy. The confirmation email you get straight afterwards tells you we received the order. It is an acknowledgement, not our acceptance.

The contract between us forms when we accept your order by shipping it, and it covers only the items in that shipment. If an order goes out in more than one parcel, each shipment is a separate acceptance.

Until we ship, we can refuse or cancel an order, in whole or in part. The usual reasons are:

  • The item is out of stock, discontinued, or was listed in error.
  • The price or description was obviously wrong.
  • The payment was declined, or we cannot verify the payment or billing details.
  • We cannot deliver to the address, or the address is outside Canada and the United States.
  • We reasonably suspect fraud, or an order placed to resell the goods or to abuse a promotion.
  • The law requires us to.

If we refuse or cancel, we release the authorization or refund the payment for the cancelled items. We do not charge a cancellation fee.

You can cancel an order yourself within 12 hours of placing it, or until it is dispatched, whichever comes first. Email support@tanahq.com with your order number. After that the order is on its way and has to be handled as a return.

Payment

Payments are processed by Stripe. Your card details go to Stripe, not to us. We never see or store your full card number.

When you place an order, the payment is authorized. That is a hold on the funds, not a charge. We capture the payment, which is when you are actually charged, at the point the order is fulfilled and shipped. Nothing is captured before then.

An authorization does not last indefinitely. If your order cannot ship before its authorization runs out, we email you and cancel the order, which releases the authorization, so nothing is ever charged for it. If you still want the items, you can then place the order again, which authorizes a new payment.

If we cancel your order before it ships, we release the authorization and nothing is captured. How quickly the hold clears from your statement is up to your bank, not us.

By placing an order you confirm that you are authorized to use the payment method and that your billing details are accurate.

Shipping, delivery and risk

Everything we sell ships from our warehouse in Brampton, Ontario, Canada. We deliver to addresses in Canada and the United States only.

Delivery dates are estimates, not guarantees. Once a parcel is with the carrier, its progress is outside our control. Current shipping options, costs and delivery estimates are on shipping and returns.

Risk of loss and damage, and ownership of the items, pass to you when the order is delivered to the address you gave us.

If a parcel arrives damaged, or the carrier says it was delivered and it was not, email support@tanahq.com and we will look into it with you. A parcel counts as lost once 10 business days have passed since the delivery estimate. To claim for one, email us with your order number.

Returns and refunds

You have 14 days from delivery to ask for a return. Items must be unworn and unwashed, with all original tags still attached. We pay return shipping when an item arrives damaged or is not as described. You pay it when you changed your mind or ordered the wrong size. We do not offer exchanges: return the item and place a new order.

Once we have received the return and checked it, we refund you to the payment method you paid with, within 5 business days of the parcel reaching us. How long the refund then takes to appear is up to your bank or card issuer.

Privacy

What we collect, who processes it for us, and the choices you have are set out in our privacy policy.

Our content and how you may use it

The photography, product descriptions, copy, page design, layout and software on this site belong to us or to our licensors, and are protected by copyright and other intellectual property law.

Our brand names and logos are our trademarks, and you may not use them without our written permission.

You may browse the site and print or save pages for your own personal, non-commercial use, such as keeping a copy of your order. That is the whole of the permission we give you. You may not:

  • Copy, republish or sell our photography or written copy, including to list the same garments elsewhere.
  • Scrape, crawl or bulk download the site, or use its content to train a model.
  • Frame or mirror the site, or remove any notice of ownership from it.
  • Present yourself as our agent, reseller or affiliate, or resell what you buy from us as if it came from us.

Acceptable use

Use the site lawfully and do not interfere with it or with anyone else's use of it. In particular, do not try to reach an account, system or data that is not yours, probe or test our security, upload anything malicious, place automated or bulk orders, or use the site to harass anyone. If you do, we can restrict or refuse your access and cancel any related orders.

Disclaimer of warranties

The site is provided as it is and as available. We do not promise that it will always be up, uninterrupted, free of errors, or secure, or that every price, stock level and delivery estimate on it is correct at every moment.

Beyond what we commit to in these terms and in our return policy, and as far as the law allows, we exclude implied warranties and conditions, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

We stand behind the items we sell and behind what we have promised here. What we do not accept is liability for indirect, incidental, special, consequential or punitive loss, or for lost profits, lost data or the cost of buying substitute goods, however the claim is framed.

A cap on our total liability for a claim connected to an order, or to your use of this site, will be set out here once it is confirmed.

Raise a problem with an order as soon as you notice it. A time limit for bringing a claim will be set out here once it is confirmed.

Nothing here limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot lawfully be limited.

Consumer protection law in Canadian provinces, and equivalent law in US states, gives you rights that a contract cannot take away. Nothing in these terms waives, limits or asks you to give up any of those rights. Where something here conflicts with a right you have under that law, that law wins for that point and the rest of these terms carry on applying.

Indemnity

If someone brings a claim against us because you broke these terms, misused the site, or infringed somebody's rights, you agree to cover our reasonable costs of dealing with it, including legal fees. We will tell you about any such claim promptly, and you may take over its defence with our agreement. This does not cover anything that was our own fault.

Governing law and where disputes are heard

These terms, and any dispute about them or about an order, are governed by the law of Ontario, Canada.

The courts that hear such a dispute will be named here once that is confirmed.

If you live somewhere else, this does not remove the protection of any mandatory consumer law of the place you live.

Changes to these terms

We can update these terms. The version on this page when you place an order is the version that governs that order, and a later change does not alter an order you have already placed.

When we change them, we update the last updated date at the foot of this page.

For a material change, we will give notice before it takes effect: an email to account holders and a notice on the site.

If part of these terms does not hold

If a court finds part of these terms unenforceable, that part is cut back to the smallest extent needed, or removed, and everything else stays in force. If we do not enforce something straight away, we have not given up the right to enforce it later. These terms, together with the policies they link to, are the whole of the agreement between us about this site and your orders.
